CHARTER

on the Youth Parliament under the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan

 

I. General provisions

  1. The Youth Parliament under the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan (hereinafter the Youth Parliament), being an advisory body that does not have the status of a legal entity, is accountable in its activities to the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan, the relevant political parties and Uzbekistan Youth Union.
  2. The Youth Parliament functions in accordance with the Constitution and laws of the Republic of Uzbekistan, decisions of the chambers of the Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and other legislative acts of the President of the Republic of Uzbekistan, as well as this Charter.
  3. The term of office of the Youth Parliament is two (2) years. At the end of the term, it ceases to exercise its powers from the day the new Youth Parliament starts working.
  4. A distinctive logo will be developed for the Youth Parliament, and its members will receive badges and certificates in the prescribed form.
  5. The official name of the Youth Parliament:
  6. a) in the state language:

full name – O’zbekiston Respublikasi Oliy Majlisi Qonunchilik palatasi huzuridagi “Yoshlar parlamenti”; abbreviated – “Yoshlar parlamenti”;

  1. b) in Russian – «Молодежный парламент» при Законодательной палате Олий Мажлиса Республики Узбекистан, сокращенно – «Молодежный парламент»;
  2. c) in English – Youth Parliament under the Legislative chamber of the Oliy Majlis of the Republic of Uzbekistan; abbreviated as Youth Parliament.

 

II. Goals and objectives of the Youth Parliament

  1. The main goals of the Youth Parliament are to support young people, increase their legal awareness and literacy, turn young people into a politically active link of society, enrich their political and legal knowledge and skills, involve young people in the legislative and lawmaking process, parliamentary activities, form legal and political culture of youth.
  2. The main tasks of the Youth Parliament are:
  3. Development of proposals for improving legislative acts to protect the legal rights and interests of youth;
  4. Discussion with participation of young people of urgent problems of lawmaking and law enforcement practice, preparation of proposals for their elimination;
  5. Organization of practical discussions on the rules of legislative technique, issues of legal and technical registration of draft laws and legal creativity;
  6. Interaction with representative bodies on increasing the political knowledge of young people, strengthening their sense of patriotism;
  7. Raising awareness of youth about parliamentary activity and all stages of lawmaking.
  8. Increasing the activity of young people in identifying new and priority areas for improving the quality of lawmaking;
  9. Promotion of further development of international cooperation in youth state policy, protection of the rights and interests of young people receiving education and working abroad, carrying out activities aimed at combating human trafficking and illegal labor migration;
  10. Development of proposals for the implementation of effective mechanisms for the prevention of delinquency among young people;
  11. Assistance in improving the legal culture of young people, expanding their intellectual, spiritual, enlightenment, aesthetic, artistic worldview.

 

III. Rights of the Youth Parliament

  1. Members of the Youth Parliament have the following rights:
  2. To request and receive documents, materials and information necessary for the preparation of issues included in the terms of reference of the Youth Parliament, in agreement with the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan, from state authorities, state and economic management bodies, educational and scientific institutions, other organizations;
  3. Use in the prescribed manner the electronic databases (banks) and information-library resources of educational and scientific institutions, centers, law enforcement agencies;
  4. Preparation of proposals and implementation of activities on draft laws, the formation of working groups consisting of scientists and specialists for the implementation of tasks within the terms of reference of the Youth Parliament;
  5. Participation in meetings of the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan, its council, committees and commissions, deputy associations.
  6. Implementation in the prescribed manner of exchange of experience and information with relevant international and foreign organizations;

 

IV. Election of members of the Youth Parliament

  1. The Republican Commission of the Youth Parliament (hereinafter the Republican Commission) manages the district (city) commissions organized for conduction of the elections to the Youth Parliament and ensures the conduction of elections in accordance with this Charter.

The composition of the Republican Commission is formed from representatives of the following organizations:

The Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan;

Institute of Problems of Legislation and Parliamentary Studies under the Oliy Majlis of the Republic of Uzbekistan;

Ministry of Justice of the Republic of Uzbekistan;

Central Council of the Youth Union of the Republic of Uzbekistan (Chairman of the Republican Commission).

  1. For the organization and conduction of elections to the Youth Parliament by the Republican Commission in all districts (cities), district (city) commissions are formed at least thirty days before the elections.

The composition of the district (city) commissions is formed from representatives of the following organizations:

Relevant district, (city) councils;

Relevant territorial bodies of justice;

Relevant territorial councils of the Youth Union (Chairman of the Commission).

District (city) commissions terminate their activities after the registration by the Republican Commission of members elected from the respective districts (cities).

  1. The start of elections to the Youth Parliament is announced by the Republican Commission in the media at least three months before the end of the term of office of members of the Youth Parliament of the previous convocation.
  2. The right to be a member of the Youth Parliament belongs to a citizen of the Republic of Uzbekistan who has reached the age of 18 on voting day, but not older than 30, having submitted a written application to the district (city) commission or an electronic application through the official website of the Youth Parliament.

Citizens who have an outstanding or unexpired conviction for committing grave or especially grave crimes are not registered as candidates.

Authors of questionnaires that meet all the requirements of this Charter are selected in two stages.

  1. In the first stage, the candidates present their pre-election program to the district (city) commission. When selecting candidates, the commission members will pay attention to the following aspects of the candidates’ pre-election program;

Latest news in legislation;

Knowledge and understanding in public administration;

Views on recent reforms in society;

The level of legal consciousness and legal culture.

Following the results of the first stage, members of the commission select 5 candidates by secret ballot (each political party has one candidate).

  1. In the second stage, the candidates present their pre-election programs in the respective district (city) councils of people’s deputies. The corresponding district (city) council of people’s deputies elects 1 candidate by secret ballot. When selecting, special attention is paid to:

Youth problems raised in the candidates’ pre-electoral program, as well as the proposed ways of solving them;

Oratorical skills of candidates, the ability to convey the essence of the project to the audience;

The level of knowledge and wit.

  1. Upon completion of each stage, a Protocol is drawn up, which is signed by the Chairman of the Commission. A copy of the Protocol is presented to the Republican Commission.

 

V. Status of a member of the Youth Parliament

  1. Member of the Youth Parliament is elected on a public basis for the term of office of the Youth Parliament. A member of the Youth Parliament cannot simultaneously be a deputy of the Legislative Chamber, a member of the Senate, or a deputy of local councils.
  2. The Republican Commission issues a certificate and a badge to a member of the Youth Parliament, which he uses during his term of office.
  3. Rights of a member of the Youth Parliament:
  4. To elect and be elected to the committees of the Youth Parliament;
  5. To forward issues for consideration at the meeting of the Youth Parliament;
  6. Submit proposals regarding the agenda of the meeting of the Youth Parliament, the procedure for considering the issues under discussion, as well as the essence and significance of these issues, express their opinions and judgments;
  7. Express an opinion on the candidatures of persons elected by the Youth Parliament.
  8. Participate in discussions at the meeting of the Youth Parliament, ask questions to the speakers and the presiding officer;
  9. To speak to substantiate their proposals, to provide explanations regarding the reasons for their voting;
  10. To present to the person chairing the meeting of the Youth Parliament the texts of his speech, proposals and considerations on the issues discussed at the meeting.
  11. In case of disagreement with the decision of the Committee, a member of which he is in the composition of the Youth Parliament, express his point of view at the meeting of the Youth Parliament or inform the Chairman of the Youth Parliament about it in writing.
  12. To enjoy the right of decisive vote on all issues discussed at the meetings of the Youth Parliament.

 

  1. Duties of a member of the Youth Parliament:
  2. Fully comply with current legislative acts, the requirements of this Charter, implement the decisions of the Youth Parliament;
  3. Actively participate in the implementation of the main goals and objectives of the Youth Parliament;
  4. In case of election at meetings of the Youth Parliament, as well as in the composition of the committee, participate in the meetings of this committee, personally participate in voting in the manner prescribed in the Charter of the Youth Parliament;
  5. If there is no opportunity to participate in the meetings of the Youth Parliament and the committee, inform the chairman of the Youth Parliament or the committee in advance;
  6. To contribute to increasing the power of influence and authority of the Youth Parliament among young people and in society;
  7. Outreach and support for the activities of the Youth Parliament;
  8. Promotion of formation of skills for the prevention of crime and delinquency among young people;
  9. Actively participate in all events, programs and projects of the Youth Parliament;
  10. Agree with the Chairman of the Youth Parliament before the independent decision of the tasks assigned to the Youth Parliament and inform him about this activity;
  11. Members of the Youth Parliament may also be assigned other responsibilities in accordance with the law.

 

  1. The term of office of a member of the Youth Parliament is terminated early if:
  2. Submission by a member of the Youth Parliament of a written statement of resignation;
  3. Election or appointment in accordance with the law to a position that prevents the exercise of the powers of the Youth Parliament.
  4. Entry into force of a conviction of a court on a criminal case against a person who is a member of the Youth Parliament;
  5. Recognition of a citizen, who is a member of the Youth Parliament, by a legally incompetent court decision;
  6. Announcement of a citizen who is a member of the Youth Parliament as deceased or recognition as missing by a court decision that has entered into legal force;
  7. Loss of citizenship of the Republic of Uzbekistan by a member of the Youth Parliament;
  8. Death of a member of the Youth Parliament.
  9. Dissolution of the chamber.

In addition, the issue of depriving the Youth Parliament of membership can be considered at the meeting of the Youth Parliament and decided by a majority vote of the total number of its members.

        

VI. Organization of the activities of the Youth Parliament

  1. The organizational form of the activity of the Youth Parliament is its plenary session, which is usually held at least twice a year. Sessions of the Youth Parliament are held in an open and transparent manner.

The order of organization and conduction of sessions of the Youth Parliament are defined in the Regulations of the Youth Parliament.

  1. The Youth Parliament makes decisions on the submitted issues, as well as on the issues of organization of the internal activities of the Youth Parliament.

Decisions of the Youth Parliament are taken by a majority vote of the total number of members of the Youth Parliament.

  1. The Youth Parliament shall elect from among its members the Chairman of the Youth Parliament and two of his deputies by a majority vote for the term of office of the Youth Parliament.

Chairman of the Youth Parliament:

  1. Convenes meetings of the Youth Parliament and preside over them;
  2. Supervises the preparation of issues submitted to the Youth Parliament for consideration;
  3. Coordinates the activities of the committees and commissions of the Youth Parliament;
  4. Distributes the tasks of members and committees of the Youth Parliament;
  5. Submits proposals developed and approved by the Youth Parliament to the chambers of the Oliy Majlis of the Republic of Uzbekistan;
  6. Enters into international cooperation in agreement with the parties.
  7. Submits proposals on hearing reports of relevant ministries, agencies and organizations on state youth policy at meetings of the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan;
  8. Signs the decisions of the Youth Parliament;
  9. Organizes control over the implementation of the decisions of the Youth Parliament;
  10. Solves other issues within the framework of his authority.

Deputy Chairmen are responsible for the effective organization of the work of the committees entrusted to them by the Youth Parliament, on behalf of the Chairman, perform some of the tasks, as well as execute the tasks of the Chairman in case of his absence or inability to carry out his duties.

 

  1. In order to effectively organize the activities of the Youth Parliament, a Council of the Youth Parliament is being created.

The Council of the Youth Parliament includes the Chairman of the Youth Parliament, his deputies, chairmen of the committees of the Youth Parliament.

Council of the Youth Parliament:

  1. Forms a draft agenda for the meeting of the Youth Parliament;
  2. Coordinates the work of the committees;
  3. Adopts decisions in accordance with the conclusion of the committee responsible for preliminary consideration of the decision on consideration or rejection of consideration of the draft proposals on youth issues by the Youth Parliament;
  4. Assists in organizing the work of a member of the Youth Parliament in districts (cities).
  5. Solves other issues related to the organization of the activities of the Youth Parliament.

The Council makes decisions on issues within its competence by a majority vote of the total number of its members.

The Council of the Youth Parliament is headed by the Chairman of the Youth Parliament, who presides over the meetings of the Council and signs its decisions.

 

  1. The Youth Parliament organizes committees from among its members, consisting of the chairman, his deputy and members for the term of office of the Youth Parliament.

The Chairman of the Youth Parliament cannot be elected to its committees.

The following committees are organized in the Youth Parliament:

  1. Committee on improving the legal literacy of youth and crime prevention;
  2. Committee on Culture and Arts;
  3. Committee on Physical Culture and Sports;
  4. Committee on Media and Innovations;
  5. Committee on Spirituality and Enlightenment and Reading Development.
  6. Committee on Science and Education;
  7. Committee for Development of Volunteering;
  8. Committee on Health, Ecology and Social Issues;
  9. Committee for Youth Employment and Youth Entrepreneurship Development;
  10. Committee on Tourism and International Affairs.

The Youth Parliament makes decisions on the election of the chairman of the Youth Parliament committee, his deputy, as well as members of the committee.

The order of activity of the committees of the Youth Parliament is determined by the Regulations of the Youth Parliament.

  1. Uzbekistan Youth Union performs the function of the Secretariat of the Youth Parliament.

The structure of the Secretariat, the staff of the Youth Parliament, the salaries of employees, material and technical support, as well as other documents necessary for work are approved by Uzbekistan Youth Union.

Labor relations of the staff of the Secretariat of the Youth Parliament do not depend on the term of office of the Youth Parliament.

 

VII. Final Provisions

  1. The speaker of the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan and the Chairman of the Central Council of Uzbekistan Youth Union can issue recommendations to members of the Youth Parliament in the process of hiring them in state bodies, enterprises, institutions and organizations.
  2. The reorganization and termination of the activities of the Youth Parliament is carried out in accordance with legislative acts.
